- The Customer agrees to pay the amount agreed to in full, in advance of initial departure for the services to be rendered for this contract.
- All deposits are non-refundable, and if possible we can move your reservation to a future date if there is a need to cancel your reservation we ask you to give us a 48-hour notice and your deposit can be moved to another date.
- City Lights Party Bus LLC is not responsible for any injuries resulting from persons entering or exiting the bus, from movements of the bus due to passengers being intoxicated, not holding on to the designated handlebars, participating in horseplay or not being seated.
- City Lights LLC is not responsible for any & all of the renter’s or passenger’s actions, before the trip, during the trip or after the trip has ended. This includes in or on public or private property, spaces, common areas, or establishments. We ask that if any passenger is too intoxicated to drive after the event you arrange an Uber or ask our drive to provide you a ride to your residence and he would most likely accommodate your request for a gratuity.
- If bodily fluids, including but not limited to vomit, are found in the bus, a minimum of a $200 clean-up fee will be charged.
- A trash bin is provided. If excessive garbage is found throughout the bus at the end of the ride, a minimum of a $50 clean-up fee will be charged. No confetti or decorations that are hard to clean up.
- The rentor signing this contract is responsible for his/her guests. City Lights Party Bus will not be held responsible for any lost, stolen or damaged articles.
- The renter will be held responsible for all damages that occur during the trip
- Any damage to the interior or exterior of the bus or equipment that is caused by an individual riding in the vehicle is the responsibility of the renter, & said individual is liable for the cost to repair any such damage as well as any cost for loss of the City Lights Party Bus service due to such damage. The renter is responsible for all legal fees, repair costs, collection costs, replacement costs, or any other court costs.
- City Lights Party Bus driver reserves the right to eject any individual(s) whom they deem to be disruptive, overly intoxicated or pose a safety threat to themselves or to others, or deemed to be using an illegal substance.
- By signing for and participating in the ride the individual agrees that he/she, if intoxicated, will not operate a motorized vehicle after leaving the party bus.
- Party Bus employees are not responsible for any claims for injuries, loss, damage, death, liability, criminal or civil litigation for the participating individual arising out of or relating to a ride.
- Mileage allowance is 30 miles per hour, anything above 30 miles in an hour is at the rate of $1 per mile, or a pre-determined mileage fee if your event is outside the metro area.
- City Lights Party Bus shall not be held responsible for late arrival caused by (but not limited to) acts of nature, traffic delays, breakdowns, incorrect pickup & drop off information, and any situation beyond our control.
- If the vehicle rental is to be for a minor under the age of (18) eighteen, this agreement must be signed by either a parent or legal guardian. City Lights Party Bus is not responsible nor is underage consumption of alcoholic beverages at any time during the ride.
Mechanical Breakdown Clause
- Mechanical Breakdown Responsibility:
In the event of a mechanical breakdown of the party bus during the rental period, the rental company will make every reasonable effort to provide a substitute vehicle or work with you to provide some kind of transportation to the next desination before the mechanical breakdown. If a replacement vehicle is not immediately available, the rental company will provide a refund for the unused portion of the rental time. The amount refunded will be based on the time lost, calculated from the moment the vehicle stops functioning until a replacement is provided or until the event ends, whichever occurs first.
2. Limitations of Liability:
The rental company is not responsible for delays or disruptions caused by mechanical breakdowns beyond its control, including but not limited to, traffic, road conditions, or acts of nature. If a breakdown occurs due to the renter’s misuse or failure to comply with the terms of the rental agreement, the renter may be held liable for any repair costs or additional expenses incurred.
- Exclusions:
This clause does not cover any breakdowns caused by actions, damage, or neglect by the renter, including but not limited to, misuse of the vehicle, failure to operate the vehicle in accordance with the manufacturer's instructions, or intentional damage caused by the renter or their guests. In such cases, the renter may be responsible for the full cost of repairs and any associated damages.
- Compensation for Lost Time:
If a breakdown results in a delay or the inability to complete the contracted party bus service, the rental company agrees to provide the renter with a pro-rated refund for the amount of time lost. This refund will be based on the total rental cost for the affected period, calculated on an hourly basis.
- Force Majeure:
The rental company will not be held liable for mechanical breakdowns or other delays caused by circumstances outside of its control, including but not limited to natural disasters, accidents, vandalism, or any other unforeseen event.
